  1. Introduction
    • Welcome to DIGAMBER JAIN SANSTHAN MELBOURNE INC (hereinafter referred to as “DJSM”, “we,” “us,” or “our”).
    • DJSM is a not-for-profit organization registered in Australia with the Australian Charities and Not-for-profits Commission (ACNC) since 26-Jan-2018.
    • The aim of DJSM is to work towards the mission mentioned in the Governing Document filed with the ACNC.
    • The governing rules mentioned in the filed document apply to the functioning of DJSM.
    • There are additional Terms and Conditions applicable when engaging with the DJSM community and its Services.
    • These additional Terms and Conditions govern your use of Services made available by DJSM to the community.
    • The Services include but not limited to the following aspects of DJSM: website, email, owned/rented/hired premises, organised events, received donations, social media handles, groups on WhatsApp, Facebook, YouTube, and any other internet platforms (collectively, the “Services”).
  2. Acceptance of Terms:
    • Use of DJSM’s Services indicates acknowledgement of having read, understood and agreed to comply with, adherence to and be bound by these Terms and Conditions in accordance with the applicable Australian law and privacy guidelines.
  3. Purpose and Scope:
    • DJSM is dedicated to providing its Services to better serve our purposes outlined in its mission statement to ACNC along with facilitating communication, administration of community affairs, the dissemination of important updates, enhancing community engagement, and the improvement of our Services.
  4. Information Collection:
    • When users interact with our Services, we may collect and retain a variety of personal and non-personal information from them. With the providing of information to DJSM on its Services, the users consent to the collection, storage, and processing of that information.
    • The collected information may include but not limited to names, addresses, contact information, demographic details, dietary preferences, likeness, any content you provide (e.g., photos or testimonials) and other relevant data.

    • We are committed to complying with the relevant Australian privacy laws, including but not limited to the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) when collecting and handling information.

    • DJSM does not store or retain your payment information on our servers.
    • All payments made are non-refundable unless otherwise stated explicitly.

    • As a user of our Services, you are responsible for maintaining the confidentiality of any associate login credentials and account information. You agree not to share your account details with others and to promptly notify us of any unauthorized use.
    • You shall not use the Services for any unlawful or unauthorized purposes.
    • When using interactive features on our Services, such as forums, discussion boards, chat groups, you agree not to post or transmit any content that is unlawful, defamatory, offensive, or infringes upon the rights of others. We reserve the right to remove any inappropriate content.

This includes using the organization’s name in a way that suggests endorsement, affiliation, sponsorship, or partnership without proper authorization.

    • User indemnifies the DJSM and its office bearers or members and keeps them indemnified against any loss sustained to it/them on account of use of the DJSM’s services.
  15. Reservation of Rights
    • DJSM reserves all rights to its name, trademarks, logos, and trade names. This includes, but is not limited to, any representation in advertising, promotional materials, websites, social media, or any other form of communication.
    • Individuals, companies, or entities seeking to use the organization’s name for any purpose must obtain explicit written permission from the authorized representative of DJSM.
    • Users who intend to engage third parties for promotional or marketing activities that involve DJSM’s name must ensure that these parties are aware of and compliant with these terms. Users remain responsible for any unauthorized actions of third parties they engage.
    • Limited use of the organization’s name for educational, editorial, or critical commentary purposes may be permissible under fair use guidelines. However, any such use must be accompanied by proper attribution and should not mislead or deceive the public.
    • Any use not expressly authorised is termed as a violation of these terms and conditions.
  16. Monitoring and Enforcement
    • We reserve the right to monitor and enforce the proper use of our name.
    • Any detected unauthorized use will be termed as a violation of these terms and may result in immediate corrective action as deemed necessary.
    • DJSM reserves the right to terminate any user’s access to its Services if it is found that the user is engaging in violation of the laid-out terms and conditions.
    • The corrective actions include the right to take legal action against any individual, company, or entity found to be in violation. Remedies for such violations may include injunctive relief, damages, and attorney’s fees.
    • In the event that we become aware of any unauthorized use of our name, we reserve the right to issue a cease-and-desist letter or take legal action to prevent further unauthorized use. DJSM may also seek damages for any harm caused by such unauthorized use.
  17. Governing Laws:
    • These Terms and Conditions are governed by and construed in accordance with the laws of Australia. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
    • Any disputes raised by the user of the DJSM’s services shall be referred to the Sole Arbitrator under the Commercial Arbitration Act for the time being in force.
  18. Limitation of Liability:
    • While we strive to provide accurate and up-to-date information, we do not guarantee the accuracy, completeness, or reliability of the content on our website or through our Services. You use our Services at your own risk.
    • To the fullest extent permissible under the law, DJSM shall not be held liable for any direct, indirect, incidental, consequential, or special damages, losses or harm arising from or associated with your use of DJSM Services.
